N.C. Pesticide Board announces case settlements

RALEIGH – The N.C. Pesticide Board recently approved the following settlement agreements. Settlements involved instances of improper buying and selling restricted-use pesticides and improper application of pesticides.

Settlements are listed by county below:

 

  • (Alamance) Marcus O. Hill of UBEES, based in Doland, S.D., agreed to pay $2,900 for using a flea and tick product in beehives in Eli Whitney, which violated five provisions of the North Carolina Pesticide Law.
  • (Chatham) Charlie W. Lemons, a licensed pesticide dealer for B&L Ag Sales in Siler City, agreed to pay $1,500 for selling a restricted-use pesticide to someone who did not have the proper license to possess the pesticide.
  • (Iredell) Sean Steinbrueck, of Mooresville, denied wrongdoing, but agreed to pay $2,750 to settle claims that he illegally purchased and used restricted-use pesticides and falsified a license in order to continue the conduct. In doing so, state investigators believe Steinbrueck violated multiple provisions of the N.C. Pesticide Law and/or Regulations.
  • (Johnston) Brandon W. Mozingo of Industry Standard Landscape in Smithfield agreed to pay $1,500 for applying a restricted-use pesticide without the proper license to do so.
  • (Onslow) Timothy Viking Phillips, a licensed commercial pesticide applicator for Viking Lawn Care in Surf City, agreed to pay $500 after an employee working under his license made an improper pesticide application to landscaping west of Sneads Ferry.
  • (Wake) Stephen G. Averette, a licensed pesticide dealer for Green Resource of the Triangle in Garner, agreed to pay $1,500 for two sales of restricted-use pesticides to people who did not have the proper licenses to possess the pesticides.
