LP Civil Penalty Resolution Options
If you have been assessed a civil penalty, you must respond within 60 days of the issue date of the letter. There are three options for resolving the penalty detailed in LP Penalty Information. Below is a summary of your options.
- Pay the assessed penalty
- Check: make the check payable to the North Carolina Department of Agriculture & Consumer Services and send it to Marcus Helfrich, Standards Division Director, 1050 Mail Service Center, Raleigh, NC 27699
- Credit Card: Call 984-236-4800 and ask to speak to Jessica Larreau. Have the inspection number ready
- Request Settlement: To request a settlement of this assessment, contact Marcus Helfrich, Director, Standards Division, at (984) 236-4755 or marcus.helfrich@ncagr.gov.
- Does NOT extend the 60-day deadline for payment
- Must present what has been done to resolve the problem leading to the violation
- Not guaranteed
- File a written petition for a contested case hearing in the Office of Administrative Hearings (OAH) appealing the civil penalty assessment. You must do the following:
- Make it in writing and using the prescribed form
- Include a $20.00 filing fee, or a fee waiver request
- Mail the original petition and an additional copy to: NC Office of Administrative Hearings, 1711 New Hope Church Rd, Raleigh, NC 27609-6285
- Send a copy of the petition to NCDA&CS to: Mr. Jonathan Lanier, North Carolina Department of Agriculture & Consumer Services, Registered Agent and General Counsel, 1001 Mail Service Center, Raleigh, North Carolina 27699-1001
